MOSCOW, August 4 (Itar-Tass) —— The guilt of Sergei Magnitsky, lawyer at the Hermitage Capital Management fund, who died in hospital of the Matrosskaya Tishina pre-trial jail, had been proved by the investigation, press service of the investigative department of Russia’s Interior Ministry told Itar-Tass on Friday.
“Over the investigation, Sergei Magnitsky’s guilt was proved fully, this is why the pre-trial investigation presented their charges over two episodes of tax evasion,” the source said. “Similar charges are presented to the UK citizen William Felix Brouder.”
The investigation will find out if relatives of Sergei Magnitsky, who was accused of tax evasion and who died in the pre-trial jail, think it necessary to bring the case to the court, press service of the investigative department of Russia’s Interior Ministry told Itar-Tass on Friday.
“Presently, over the additional investigation, the investigator must find out view of Magnitsky’s relatives abut termination of the criminal case /due to his death/,” the source said. “Should they object, the criminal case procedures will be continued to be forwarded to the court.”
“Should the relatives refuse from continuation of the criminal case, the preliminary investigation will not have legal grounds to consider that their legal interests are violated by the decision of the investigation to terminate the criminal case, and the statement on violation of Magnitsky’s right for rehabilitation are not caused by the intention to rehabilitate them.”
